Navigating the Attack on DEI: Take Aim at the Future

If you’ve read the news recently, you have probably noticed that the legal landscape around Diversity, Equity, and Inclusion (DEI) initiatives is rapidly evolving, with numerous legal challenges emerging across different sectors. Following the Supreme Court’s decision in June 2023 that ended race-based affirmative action in higher education, there’s been a significant uptick in litigation challenging various aspects of DEI practices. This litigation primarily targets employment-related DEI practices, charitable institutions, vendor and supplier diversity programs, corporate board governance, and investment strategies.
Political actions against DEI and Environmental, Social, and Governance (ESG) initiatives have also been notable. In 2023, over 150 anti-ESG bills and resolutions were introduced across 37 states, with at least 40 anti-ESG laws enacted in 18 states. These legislative actions span a range of areas, from contracting restrictions and investment decision-making to anti-discrimination laws. With reports from Morningstar mentioning that in the first nine months of 2023 alone investors pulled more than 14 million dollars from ESG funds.
The legal and political actions reflect a broader backlash against DEI and ESG initiatives in some segments of American society and our legal system. For example, lawsuits have targeted government contracting decisions, funding decisions, and even law firm diversity fellowships. Moreover, some states have considered or passed laws aimed directly at DEI initiatives, with efforts to extend the Supreme Court’s decision on affirmative action to the workplace. My state governor Ron DeSantis will be quoted in history books as saying “Florida is the place where DEI goes to die.”
On the corporate side, the response to these challenges involves navigating a complex and shifting legal landscape. Companies are advised to evaluate their DEI and ESG programs carefully, assessing legal risks and developing strategies to mitigate potential legal challenges. This may include a focus on inclusion and belonging as a way to support diverse workforces while potentially reducing legal exposure.
This wave of legal and political challenges highlights the tension between advancing DEI goals and navigating the risks of litigation and legislative pushback.
